By accessing or using Achek Cloud ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We reserve the right to update these terms at any time, and continued use of the Service constitutes acceptance of any changes.
Achek Cloud is a platform that allows users to host, deploy, and manage WhatsApp bots powered by AchekBot. The Service provides bot hosting infrastructure, session management, billing, and monitoring tools. We do not guarantee uninterrupted, error-free operation of the Service.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.
You agree to use bots hosted on Achek Cloud in compliance with WhatsApp's Terms of Service and Acceptable Use Policy. You must not use the Service to send spam, unsolicited messages, or engage in any fraudulent, illegal, or harmful activities through WhatsApp. Violation of WhatsApp's policies may result in the suspension of your bot sessions and account.
Achek Cloud offers free trial and paid subscription plans. Billing is processed through Paystack. Subscription fees are charged in advance and are non-refundable except at our discretion. We reserve the right to change pricing with reasonable notice. Failure to pay may result in suspension of your bots and account.
You agree not to use the Service to: (a) send spam or unsolicited commercial messages; (b) harass, threaten, or intimidate any person; (c) distribute malware, viruses, or harmful code; (d) violate any applicable law or regulation; (e) infringe on intellectual property rights; (f) impersonate any person or entity. We reserve the right to terminate access for violations without notice or refund.
We collect and process data as described in our Privacy Policy. Your WhatsApp session keys and bot configurations are stored securely and are used solely to provide the Service. We do not sell your personal data to third parties.
The Achek Cloud platform, brand, and software are owned by Achek and protected by intellectual property laws. AchekBot is open-source software licensed under GPL-3.0. You retain ownership of your bot configurations and data.
The Service is provided "as is" without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free from viruses. We are not responsible for any loss of data, revenue, or business resulting from use of the Service.
To the maximum extent permitted by law, Achek Cloud shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Service. Our total liability to you shall not exceed the amount you paid us in the three months preceding the claim.
Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease and your data may be deleted after 30 days. Provisions that by their nature should survive termination shall survive.
These Terms shall be governed by the laws of the Federal Republic of Nigeria. Any disputes shall be resolved through arbitration or in Nigerian courts.
